Terms of Service

By using lefling.com or signing up for a Le Fling membership, you agree to these terms. Please read them carefully.

1. Membership

Le Fling offers subscription-based access to fine jewelry. All subscription tiers (Casual Fling, Summer Fling, Steady Fling, Serious Fling) require a 3-month minimum commitment. After 90 days, you may cancel with 30 days written notice. The One-Night Stand is a single 7-day rental with no recurring commitment.

2. Eligibility

You must be at least 18 years old and a resident of the continental United States. At signup, you will be required to provide a government-issued photo ID, a valid credit or debit card, and a verified phone number. One account per person.

3. Billing

Subscription fees are billed monthly on your billing date. A pre-authorization hold will be placed on your card at signup (amount varies by tier). The hold is released after your first successful return. Failed payments will be retried 3 times over 10 days. If all retries fail, your membership is suspended and outstanding pieces must be returned within 7 days.

4. The Jewelry

All pieces remain the property of Le Fling until purchased through The Monogamist program. Pieces are for personal wear only by the account holder. You may not loan, gift, resell, alter, resize, engrave, or take pieces outside the continental United States.

5. Swaps

Each tier includes 1 free swap per month. Additional swaps cost $15 each. When you request a swap, we ship the new piece immediately with a prepaid return label for the current one. The outgoing piece must be returned within 5 business days. Pieces not returned within 21 days are treated as non-returns (see Section 8).

6. Care

Pieces must be stored in the provided case when not worn. Do not expose pieces to harsh chemicals, wear them during high-impact activities, or attempt any modifications. Normal wear and tear is expected and covered. A care guide is included with every shipment.

7. Damage

Accidental damage coverage is included with all tiers, subject to a deductible (Casual: $75, Summer: $150, Steady: $300, Serious: $500, One-Night Stand: $200). Significant damage includes lost or cracked stones, broken clasps or settings, and bent metalwork. Intentional damage or gross negligence results in a charge for the full retail replacement value. All damage assessments are performed by our in-house gemologists.

8. Non-Return, Loss, and Theft

If a piece is not returned within 21 days of a swap request, cancellation, or rental period end, we may charge your card up to the full retail replacement value to the extent permitted by law. If a piece is lost or stolen, you must notify us within 24 hours and file a police report within 48 hours. With a valid police report, the applicable deductible applies. Without a police report, up to full retail value may be charged.

9. The Monogamist (Rent-to-Own)

Every piece has a member buyout price at up to 50% off retail. You may pay it in full at any time, or a portion of your monthly subscription is credited toward the buyout price of the piece you currently hold. Credits only accrue on pieces held for 30+ consecutive days and are forfeited if the piece is swapped. All buyout sales are final.

10. Security Deposits

The Serious Fling tier requires a $500 refundable security deposit at signup. The deposit is refunded within 14 business days of cancellation in good standing (all pieces returned, no outstanding damage).

11. Cancellation

After the 3-month minimum, cancel anytime with 30 days notice. All pieces must be returned within 7 days of your cancellation effective date. No refunds for partial months.

12. Fraud

Fraudulent activity (false identity, stolen cards, selling or pawning rented pieces, returning counterfeits, filing false police reports, or opening multiple accounts) may result in immediate termination, charges for outstanding balances and losses, civil collection efforts, and referral to law enforcement where appropriate.

13. Limitation of Liability

To the maximum extent permitted by law, Le Fling's total liability for any claim shall not exceed the subscription fees you paid in the preceding 12 months. We are not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Dispute Resolution

Except where prohibited by law, disputes arising from these Terms will be resolved by binding arbitration administered by the American Arbitration Association in New York, NY. You and Le Fling agree to bring claims only in an individual capacity and not as a class, collective, or representative action. Either party may bring qualifying claims in small claims court. If a court determines any part of this section is unenforceable, the remaining parts still apply to the fullest extent permitted by law.

15. Changes

We may update these Terms from time to time. For material changes, we will provide notice at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance, except where additional consent is required by law.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where consumer protection laws in your state of residence require otherwise.

17. Consumer Rights Notice

You may have specific consumer rights under state law that cannot be waived by contract. Nothing in these Terms is intended to limit those rights.

All Le Fling jewelry is manufactured by Ultimate Diamond, a family-owned jewelry manufacturer operating in New York's Diamond District since 1959. Every piece is certified by IGI or GIA.
